18 Attorneys General Move to Block CLARITY Act Before Vote

The crypto industry's biggest legislative test just got harder. Eighteen state attorneys general, led by New York's Letitia James, wrote to Senate Banking Committee leaders on 14 September urging them to reject the Digital Asset Market Clarity Act in its current form, one day before the Senate votes on whether to take it up.

Their argument is about who gets to prosecute fraud. The coalition says the bill would strip states of enforcement powers at exactly the moment digital asset scams are accelerating. In an official statement, James urged Congress not to pass it, stating,

"As written, the Clarity Act would embolden scammers and potentially strip attorneys general of our authority to protect our states' investors and their wallets."

What the Attorneys General Argue

The letter's core claim is that state prosecutors do the bulk of the work on crypto fraud, and the bill would take away the tools they use.

"As the epidemic of online scams continues to grow, we remain firmly opposed to any federal statutory changes that would displace states' authority to oversee the securities and commodities markets to protect everyday Americans," the coalition wrote in the letter.

The sharper technical objection concerns preemption. The coalition argues the bill would allow the Securities and Exchange Commission to override state registration authority, and that the language granting it is broad enough to reach well beyond crypto.

According to the New York attorney general, that authority "would not only apply to digital assets but would also broadly grant unilateral discretion to SEC to reset the scope of federal preemption, potentially upending the state securities regulatory regime."

That is the part worth reading twice. The objection is not only that crypto oversight moves to Washington, but that a single agency could redraw the federal-state boundary for securities regulation generally, without going back to Congress.

The Bipartisan Detail that Matters

The coalition's composition is the politically significant part. Attorneys general from California, Illinois, Arizona, Wisconsin and others signed. Moreover, the letter is not purely Democratic: Republican attorneys general from Kansas and Ohio joined, according to the Washington Examiner.

That matters for the vote arithmetic. The CLARITY Act needs 60 votes to clear cloture, and with 53 Republicans in the chamber, at least seven Democrats have to cross over. A letter signed only by Democratic AGs would read as partisan positioning. One carrying Republican signatures gives wavering Democrats cover to vote no, and makes it harder for supporters to dismiss the objection as obstruction.

James has been building this case for months. She submitted written testimony on 28 July urging lawmakers to preserve state authority to prosecute fraud, and has separately pushed for stronger anti-money-laundering and ethics safeguards.

The Revised Bill Did Not Settle It

Senate Republicans released a revised draft over the weekend incorporating more than 100 changes requested by Democrats, intended to strengthen ethics provisions and clarify the role of state enforcement within the federal framework.

The coalition sent its letter anyway. Their position is that even with the amendments, the language on state authority stays ambiguous enough to invite future challenges to states' ability to fight fraud.

What Happens Tuesday

The 15 September vote is procedural rather than final. It is a motion to proceed, which ends debate and clears the way for floor consideration, and it needs the same 60-vote supermajority the bill itself requires. That makes it a reliable read on whether the bill has a path ahead this year.

Coinbase chief executive Brian Armstrong said last week he expects the bill to clear the threshold, arguing Majority Leader John Thune would not have scheduled the vote otherwise. Prediction markets have been considerably less convinced, with Polymarket odds on passage in 2026 sliding from 82% in February to around 16% by early September.

An eleventh-hour letter from 18 state law enforcement offices does not change the count on its own. What it does is hand undecided senators a reason, and a bipartisan one, to wait. If cloture fails on Tuesday, attention moves to 16 September, when the CFTC and SEC have signalled they could begin writing rules without Congress.
